1. Operating Entity & Regulatory Scope
These Terms & Conditions govern the access and use of the platform provided by Third Estate. Third Estate operates strictly under its lawful business activities registered under the Udyam Registration framework (Ministry of Micro, Small and Medium Enterprises, Government of India).
Current platform activities are strictly restricted to public-interest workforce data collection, empirical market research, research analytics, and digital transparency reporting. Third Estate is neither a chartered commercial banking institution nor does it solicit unauthorized public deposits or issue insurance policies without prior statutory approvals.
2. Deliverables & Contractual Obligations
Any transaction, contribution, or platform fee processed through our authorized payment aggregators purchases direct access to our enhanced data transparency disclosures, aggregated market analytics, and defined member benefits[cite: 17]. Upon receipt of payment, Third Estate enters into a binding contractual commitment to apply its best commercial and professional efforts toward fulfilling its outlined mission, operational roadmap, and transparency standards on behalf of its contributors[cite: 17].
3. Force Majeure & Limitation of Liability
Third Estate’s contractual commitment to execute its mission and vision is expressly subject to, and excused by, events of Force Majeure. Neither Third Estate, its founders, nor its operating affiliates shall be held legally liable or in breach of contract for failure or delay in performance resulting from causes beyond reasonable control.
Force Majeure events include, but are not limited to:
- Acts of God, natural catastrophes, pandemics, epidemics, or environmental crises.
- Governmental actions, regulatory moratoria, legislative embargoes, statutory injunctions, or court orders.
- Socio-political disruptions, civil unrest, war, riots, strikes, or widespread industrial actions.
- Macroeconomic turbulence, market collapse, involuntary insolvency, or systemic financial freeze.
- Prolonged physical incapacity, severe medical disability, or death of the core founding members.
- Third-party gateway downtimes, telecommunication blackouts, or server failures beyond direct administrative influence.
4. User Obligations & Survey Integrity
Users engaging with our surveys, community pipelines, and data reporting tools agree to provide accurate, honest, and lawful information. All survey responses are collected and processed in aggregated, anonymized formats in strict accordance with our Privacy Policy.
5. Governing Law & Dispute Resolution
These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts in Kerala, India.
